Definition of purchase
MAMbo – Istituzione Galleria d’Arte Moderna – Comune di Bologna (hereinafter referred to as "MAMbo" or "Museum"), with main office in via Don Minzoni, 14, 40121 Bologna. Tel. +39 (0)51 6496611 - Fax +39 (0)51 6496600, tax-payer code/VAT position 01232710374 enables Customers to purchase online, through its Web site,, the catalogued volumes published and/or sold by MAMbo and the gadgets with the Museum logo.

Prior to purchasing any product, Customers must accept these general sales conditions (hereinafter referred to as "General conditions") and the privacy policy, pursuant to Law no. 196/03 concerning the protection of personal data.


General conditions and payment options
The general conditions are regulated by Italian laws, by Legislative Decree no. 185 of 22.05.1999, which implements Directive 1997/7/EC, concerning the protection of consumers in relation to distance contracts, and Legislative Decree no. 70 dated 9.04.2003, which implements Directive 2000/31/EC that disciplines some of the juridical aspects of the information society services and in particular electronic commerce.

MAMbo reserves the right not to accept incomplete or incorrectly completed orders.

If the order cannot be processed by MAMbo due to the unavailability of the volumes or gadgets ordered by the Customer, MAMbo agrees to promptly inform the Customer, within the terms and following the procedures set forth by Italian laws, and to refund the sum paid for the item that has not been supplied without withholding any fee.

The delivery fees for catalogues and gadgets have to be paid by the Customer. Items are delivered by UPS at the standard fee, generally within 48 working hours from the shipping date.

MAMbo reserves the right to ship the products only after it has received the payment.

The prices of the volumes and gadgets offered on the Web site are in Euro and include the taxes foreseen by law.

When completing their orders, Customers can choose whether to pay online by credit card, in which case the invoice is issued immediately, or by bank transfer, in which case they will receive the invoice at home as soon as MAMbo receives the actual payment. Commissions will have to be paid by the Customer and will be detailed in the summary of the order.


Right of withdrawal
All purchases made through MAMbo's Web site are regulated by Italian laws. In the event of incorrect order and/or receipt of an undesired item, Customers will have 10 working days from the date of receipt to exercise the right of withdrawal and return the items, provided they preventively notify their intention by sending an e-mail to and specify the type of product, quantity and return reason. All returns must be explicitly authorised by one of MAMbo's representatives and a copy of the authorization shall will have to be sent together with the returned item. Items must be returned within 10 days from the receipt of the return authorisation. After receiving the items and assessing their integrity, MAMbo shall refund the Customer the cost of the returned items in the shortest time possible, withholding, when applicable, the transport costs, if they have not been paid by the Customer, as the latter is directly responsible for the payment pursuant to Italian laws. The reversal document (credit note) shall be sent by MAMbo to the Customer by ordinary mail.

Attention: items with SIAE seals must be returned with an integral seal. Items returned with broken or missing SIAE seals shall not be accepted. Items returned with a broken or missing SIAE seal will be redelivered to the sender, who will be expected to pay the additional transport costs incurred by MAMbo.

Customers shall not be able to exercise the right of withdrawal if the purchased volumes consist of sealed audiovisual material or software, that has been opened by the Customer or if the volumes are damaged. All materials attached to the volumes (like audiocassettes, CD-ROMs, DVDs, etc.) will have to be returned sealed along with the volumes.


Disputes and competent court
These general conditions are regulated by Italian laws. For all disputes concerning the protection of consumers, the compulsory territorial competence shall rest in the court of the place of residence or domicile of the Customer, if located within the Italian territory (Legislative Decree no. 185 of 22.05.1999, which implements Directive 1997/7/EC concerning the protection of consumers in relation to distance contracts).

All disputes related to these general conditions shall be settled in accordance with the provisions of the Brussels Convention of 27/09/1968 and Regulation 44/2001/EC.
